Will my insurance company pay my claim quickly without investigating the accident?
Unfortunately, many insurance companies do not pay money willingly. Insurance companies can be expected to thoroughly investigate the facts of an accident, all claims for medical treatment and past injuries or claims. In some instances, insurance companies may obtain copies of past medical records.
What other ways might my insurance company investigate my injury?
An insurance company might hire a private investigator to make movies of any physical activity you engage in. Some insurance companies have even been known to lay a trap for claimants, such as attempting to hire you to do physical activity, etc.
With whom should I discuss my case?
An insurance company may hire a private investigator to investigate your claim. These investigators have been known to carry concealed recording devices. To ensure that you do not fall victim to these tactics, it is important that you not discuss your case with anyone, including friends, until you have had an opportunity to discuss your case with your attorney.
Should I inform my lawyer of a prior injury or of prior pain that I have experienced?
It is always important to be truthful, and this includes telling us about any prior injury or prior pain. Many good cases are lost because the injured person conceals or forgets a previous injury.
What information regarding my medical treatment will I need to provide to my attorney?
You should be sure to provide our office with the names and addresses of all doctors and medical facilities that have treated you. It is also important to keep track of all medical expenses and bills. Also, please provide us with copies of all medical expenses and bills, including Explanation of Benefits (EOBs).
Should I inform my attorney of any previous claims I have made?
Insurance companies keep a record of any and all claims against their companies. Even so, it is important to give your attorney this information.
What should I share with my doctor regarding my accident?
Tell your local doctor all of your complaints. The doctor’s records can only be as complete as the explanation of your pains and injuries. You may even want to keep a diary of your complaints to help you remember.
What about my prescriptions and medications? Will my lawyer need to know about them?
Keep track of all prescriptions and medicines you have taken, preferably saving all bottles and containers of. Please provide us with copies of all prescription expenses and bills.
Will I need witnesses to testify about my medical condition?
It may be necessary to have friends, neighbors or co-workers testify regarding your disability and pain and suffering; therefore, start thinking about the witnesses you may need in the future.
What other information will my attorney need?
Keep us informed of anything that in any way may affect your case. Keep our office advised of any vacation times when you may not be available. An emergency telephone number and an alternate way of reaching you must be in our file at all times.
What expenses will be incurred to pursue my claim?
Some of the necessary expenses of your injury claim include costs of obtaining the police report, copy fees, filing fees, obtaining medical records and medical reports from treating physicians or medical facilities, depositions, transcripts and witness/expert fees.
How long will my claim take to complete?
It is important to remember that each claim is unique and proceeds on its own timeline. It can sometimes take months or even years to conclude a case. In fact, in some instances, it can be dangerous to settle certain types of claims too soon because it often takes a long time for serious injuries to become evident.
